General Terms and Conditions

Last updated: 22 August 2026

§ 1 Scope and contracting parties

These General Terms and Conditions apply to all services provided via the websites cleverbauen24.de and www.cleverbauen24.de (hereinafter the “Platform”) by

Berat Murati

(hereinafter the “Provider”).

The Platform is primarily intended for consumers within the meaning of § 13 BGB (hereinafter the “Customer”). Use by businesses within the meaning of § 14 BGB is not excluded; however, the following provisions also apply in that case.

Any differing general terms and conditions of the Customer do not apply unless the Provider expressly agrees to their application in writing.

§ 2 Description of services

The Provider supplies the following services for reviewing building quotes and supporting project owners:

A. Free initial assessment (Quickcheck)

The Customer uploads one or more quote documents (PDF) and receives an AI-assisted initial assessment of their building quote. This includes an automated analysis using artificial intelligence and provides a summary evaluation with a risk assessment. The initial assessment does not constitute legal, construction or financial advice and does not replace a review by a professional.

B. Paid quote review (full report)

The Customer commissions a detailed review of their building quote. This includes:

  • Extraction and listing of all quoted items
  • AI-assisted analysis according to defined review rules (e. g. variation risks, scope boundary deficiencies, price transparency, completeness, liability risks)
  • Deterministic additional checks (quantity plausibility, price plausibility, scope of work)
  • Manual quality control by the Provider
  • Preparation and delivery of a review report as a PDF by email
  • Access to the Owner's Toolkit with templates, checklists and practical resources for project owners

The analysis is generated predominantly by AI systems and subsequently quality-checked by the Provider. The review report serves as guidance; it is not legal advice, an expert report or a guarantee of the accuracy or completeness of the results.

The review expressly does NOT include:

  • Site appointments or construction site visits
  • Comparison with building plans, floor plans, site measurements, bills of quantities or other documents not uploaded by the Customer
  • Consultations with the contractor carrying out the work, architects or other third parties
  • Verbal or written ancillary agreements between the Customer and the contractor that are not recorded in the submitted documents
  • Checks of the contractor's creditworthiness or reliability
  • Assessment of the actual workmanship or site conditions
  • Comparison with earlier quote versions, negotiation records or site measurements that were not uploaded
  • Assessment of material and product quality beyond the specifications stated in the quote itself

The Provider bases its review on the documents submitted by the Customer and assumes these are complete, current and truthful. Differences between actual site conditions and the submitted documents fall outside the Provider's responsibility.

The Provider offers two plans:

  • Basic full report – Delivery within 4 working days (Mon–Fri) of receipt of payment
  • Express full report – Delivery within 24 hours of receipt of payment

C. Owner's Toolkit (available separately)

The Owner's Toolkit is a collection of 16 templates, checklists, records and sample letters for project owners, available as a PDF download. It can be purchased either as part of the paid quote review (see B) or as a standalone product.

D. Bill of quantities (LV generator)

The Provider prepares a property-specific bill of quantities based on the project data entered by the Customer in the renovation calculator (cost calculator). The service includes:

  • Filtering a curated item catalogue according to the trades, rooms, areas, construction year and renovation scope specified by the Customer
  • AI-assisted additions of material specifications and DIN/VOB references to items
  • Delivery as a PDF document and an editable Excel file (.xlsx) by email

The bill of quantities provides costing guidance and does not replace tender documentation by an architect or specialist designer. Quantities are based on data entered by the Customer; before work begins, the Provider recommends on-site measurement by the contractor carrying out the work. The price is the one shown in the Platform's price overview at the time of ordering.

Delivery takes place immediately after payment is received, generally within a few minutes and no later than within 24 hours. As this is digital content made available immediately, the right of withdrawal expires following the Customer's express consent under § 356 Abs. 5 BGB (see § 6).

The current prices for all services above are shown in the Platform's price overview at the time of ordering. The analysis results do not constitute legal, tax or construction advice and do not replace a review by a specialist lawyer, building expert or architect.

E. Renovation advice & construction company matching (free)

By submitting the form in the renovation calculator or specialist company matching wizard, the Customer commissions the Provider to supply the following free services:

  • Initial telephone consultation with a renovation specialist to discuss the building project (scope, trades, timeframe, regional market prices)
  • Based on this consultation, introduction to up to three construction companies selected from the Provider's network whose profiles suit the project
  • Sharing the Customer's contact and project details with the selected construction companies so that they can prepare a specific quote

This service is free for the Customer. Any referral commission is charged exclusively to the introduced construction company (if a contract is awarded), not to the Customer. The introduction does not oblige the Customer to commission any of the proposed construction companies.

The Provider admits construction companies to its network only after a documented review. In particular, the following are checked:

  • the business registration,
  • entry in the Register of Skilled Crafts, where required for the relevant trade,
  • proof of current public liability insurance,
  • references from completed projects.

Evidence is collected and documented on admission and requested again at regular intervals. The review concerns the evidence above and professional and regional suitability. It does not make any statement about the quality of workmanship in an individual case. The contract is awarded directly between the Customer and the construction company; the Provider does not become a party to the construction contract and is not liable for performance by the introduced company.

The Customer may at any time email info@cleverbauen24.de to request that their data no longer be shared with construction companies. Such a restriction cannot cover referral data already sent.

F. Customer's duties to cooperate

The service owed by the Provider is a document review. A proper review requires the Customer to provide the Provider with all documents relevant to the assessment, completely and truthfully. These documents include in particular:

  • the complete, current building quote, including all appendices
  • existing bills of quantities, building plans, floor plans or site measurements, insofar as they are available to the Customer and relevant to assessing the stated quantities or work
  • earlier quote versions and documented negotiation records, where negotiations have already taken place
  • known ancillary agreements, verbal assurances or further agreements with the contractor, insofar as they affect scope or prices

By commissioning the service, the Customer confirms that the documents submitted include all documents known to them and relevant to the review. If the Customer fails to submit relevant documents, deviations or disadvantages resulting solely from this fall within the Customer's responsibility (§ 254 BGB) and do not constitute a defect in the Provider's service. If, during processing, it becomes apparent to the Provider that documents essential to the assessment are missing, the Provider will inform the Customer.

§ 3 Formation of the contract

The presentation of services on the Platform does not constitute a legally binding offer, but an invitation to submit an offer (invitatio ad offerendum).

A. Free initial assessment

By uploading a quote document and submitting the form, the Customer accepts the Provider's offer to carry out a free initial assessment. A contractual relationship arises when the form is submitted. There is no entitlement to availability of the service.

B. Paid quote review

The ordering process is as follows:

  1. The Customer enters their contact details and uploads the quote document to be reviewed.
  2. The Customer adds project details (location, property type, nature of the project) and optional notes.
  3. The Customer chooses a plan (Basic full report or Express full report), accepts these Terms and Conditions and the Privacy Policy, and is redirected to payment service provider Stripe for payment processing.
  4. The contract is formed upon successful payment. The Customer receives an order confirmation by email.

When using a voucher code covering the full amount (100 % voucher), the contract is deemed formed when the ordering process is completed, even if no payment is made.

C. Contract text, input errors and contract language

The Provider stores the contract text and sends it to the Customer by email together with the order confirmation. The applicable Terms and Conditions are also available on the Platform at any time.

Before submitting the order, the Customer can check their entries on the overview page and correct them at any time using the order form's back function.

Contracts are concluded exclusively in German.

The technical steps leading to formation of the contract are set out in the ordering process described above.

§ 4 Prices and payment

All prices shown on the Platform are final prices in euros, including statutory VAT, currently 19 %.

Payment is made exclusively through payment service provider Stripe (Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland). The purchase price is due before the service is provided. Available payment methods are shown to the Customer during checkout.

The Provider may issue voucher codes and referral codes. These can be redeemed once, cannot be combined with other promotions and are not transferable unless expressly stated otherwise. Voucher value cannot be paid out in cash. The Provider reserves the right to deactivate voucher codes at any time.

§ 5 Delivery and provision of services

A. Free initial assessment

The result is displayed on the Platform immediately after the automated analysis is complete and is also emailed to the address supplied by the Customer. Processing generally takes a few minutes but may vary during busy periods. There is no entitlement to a specific delivery time.

B. Paid quote review

After analysis and quality control are complete, the review report is sent as a PDF by email to the address supplied by the Customer. The delivery period depends on the chosen plan:

  • Basic full report – within 4 working days (Mon–Fri) of receipt of payment
  • Express full report – within 24 hours of receipt of payment

Access to the Owner's Toolkit is provided to the Customer by email after payment is received.

Provision of the service requires a legible, complete PDF document of the building quote to be reviewed. If technical faults or incomplete or illegible documents prevent provision of the service, the Provider will inform the Customer promptly. In this case, the Customer is entitled to a full refund of the amount paid or the option to upload again.

C. Satisfaction promise for paid quote reviews

(1) If the review report contains no finding relevant to the assessment, the Provider will refund the Customer the full amount paid for the quote review. The Customer is entitled to this refund.

(2) A finding relevant to the assessment is any finding stated in the review report that contributed to the overall assessment of the building quote shown there. Purely formal observations with no effect on the overall assessment do not count.

(3) The refund requires that:

  • the submitted document constitutes a reviewable building quote within the meaning of § 2 B,
  • the document is complete and legible.

(4) The refund is made through the original payment method within 14 days of delivery of the review report.

(5) The Customer's statutory warranty rights (§ 8) and claims for damages (§ 7) remain unaffected.

§ 6 Right of withdrawal

Withdrawal information

Consumers have the right to withdraw from the contract within fourteen days without giving reasons. The withdrawal period is fourteen days from the date the contract is concluded.

To exercise your right of withdrawal, you must inform us

Berat Murati

Sole trader · trading name “cleverbauen24”

Schönleinstraße 4, 10967 Berlin

Email: info@cleverbauen24.de

Telephone: +49 30 75 43 69 45

by an unequivocal statement (e. g. a letter sent by email) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient to send your notification of exercising the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we must refund all payments received from you promptly and no later than fourteen days from the day we receive notice of your withdrawal. We will use the same payment method you used for the original transaction unless expressly agreed otherwise with you.

If you requested that the service begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of services already provided up to the point when you inform us that you are exercising your right of withdrawal from this contract, relative to the full scope of services provided for in the contract.

Early expiry of the right of withdrawal

For a service contract, the right of withdrawal expires once the Provider has fully provided the service, provided the Provider began performance only after the Customer gave express consent and simultaneously acknowledged that they would lose their right of withdrawal upon full performance of the contract (§ 356 Abs. 4 BGB).

For digital content (e. g. the Owner's Toolkit as a PDF download), the right of withdrawal expires once the Provider has begun performance of the contract after the Customer expressly consented to performance beginning before the withdrawal period expired and acknowledged that giving this consent meant losing their right of withdrawal (§ 356 Abs. 5 BGB).

§ 7 AI use and liability

AI-assisted analysis

The Customer is informed that the analysis, both for the free initial assessment and the paid quote review, is generated predominantly by artificial intelligence systems. The paid quote review also undergoes manual quality control by the Provider.

The analysis results provide technical guidance. In particular, they do not replace:

  • a review by a building expert or architect
  • legal advice from an authorised lawyer
  • a building expert report within the meaning of applicable standards

The Provider gives no warranty as to the completeness, accuracy or currency of the AI-assisted analysis results. Decisions the Customer makes based on the analysis are at their own risk.

Assessments of third-party quotes

Assessments in the review report relate exclusively to the items, quantities, prices and wording documented in the quote submitted by the Customer. They do not assess the contractor as a business or make statements about its commercial reliability, capability or quality beyond the specific quote reviewed. The Customer is responsible for their use of the review report towards third parties (particularly the contractor).

Limitation of liability

The Provider has unlimited liability for damage arising from injury to life, body or health, and for intent and gross negligence.

For ordinary negligence, the Provider is liable only for breach of essential contractual obligations (cardinal obligations). Essential contractual obligations are those whose fulfilment makes proper performance of the contract possible and on whose observance the Customer regularly relies. In this case, liability is limited to damage typical of the contract and foreseeable when the contract was concluded.

For the free initial assessment (Quickcheck), liability for ordinary negligence is limited to compensation for typical, foreseeable damage; liability beyond this is excluded insofar as legally permissible.

The above limitations of liability also apply for the benefit of the Provider's agents.

§ 8 Warranty

The Customer is entitled to performance in accordance with the contract. Statutory warranty provisions apply.

If the review report has technical defects (e. g. missing sections, incorrect display, incomplete item extraction due to a system error), the Customer may request rectification.

There is no defect if:

  • the AI analysis fails to identify an issue that cannot reliably be detected by machine using the current state of technology,
  • the Customer uploaded incomplete, illegible or incorrect documents or failed to comply with their duties to cooperate under § 2 F,
  • the alleged deviation could only have been identified through documents, site visits or information expressly excluded from the review (§ 2 B),
  • the Customer disagrees with the weighting of individual review points within the stated review methodology.

The Owner's Toolkit and bill of quantities are digital products. The special consumer provisions of §§ 327 ff. BGB also apply to them. If such a product is defective, the Customer may initially require the Provider to remedy the defect under § 327i BGB. If this is unsuccessful, the Customer may reduce the price or terminate the contract and, subject to the statutory conditions, claim damages or reimbursement of wasted expenditure.

§ 9 Rights to use the review report

Upon full payment, the Customer receives a non-exclusive, non-transferable right to use the review report produced and the Owner's Toolkit. The Customer may use the content for their own purposes, particularly for presenting it to contractors, architects or advisers.

Publication, reproduction for commercial purposes or disclosure to third parties for resale is not permitted without the Provider's prior written consent. The review reports produced and the Owner's Toolkit are protected by copyright.

The Customer may freely use the results of the free initial assessment. No right to use the underlying analysis methodology or algorithms is granted.

§ 10 Data protection

Personal data is processed in accordance with our Privacy Policy.

§ 11 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If the Customer is a consumer, the mandatory consumer protection provisions of the country in which the Customer habitually resides apply if they are more favourable to the Customer.

If the Customer is a merchant, a legal person governed by public law or a special fund governed by public law, Berlin is the exclusive place of jurisdiction for all disputes arising from this contract.

The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions remains unaffected.
